Purchases and Pricing

If you wish to purchase any product or service, request a 30 day loaner, RMA, or advanced replacement, made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your purchase including, without limitation, your name, credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

The Service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order/request at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Risk of Loss and Returns

All Deliveries to you of Purchases from AV Costar are made pursuant to a shipment contract with a third party carrier. The risk of loss and title for your Purchases will pass to you upon our delivery to the carrier. AV Costar will not be responsible for any losses or damages that you may incur as a result of the shipment of Purchases to you.

Availability, Errors and Inaccuracies

We are constantly updating product and service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other web sites. Termination

Applicable Law

By using any the Service, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of California, without regard to principles of conflict of laws, as applicable, will govern these Terms and Conditions and any dispute of any sort that might arise between you and AV Costar.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court or other tribunal, the remaining provisions of these Terms will remain in effect. These Terms , together with the Privacy Policy and the Refund Policy, constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Disputes

Any dispute or claim relating in any way to your use of any Service, or to any products manufactured or distributed by AV Costar will first be resolved by a mutually agreed-upon mediator in Los Angeles, California. Any costs and fees other than each party’s attorney fees associated with the mediation will be shared equally by each party.

If it proves impossible to arrive at a mutually satisfactory solution through mediation, all parties will submit to binding arbitration in Los Angeles, California under the rules of the American Arbitration Association, applying California law and, to the extent applicable, the Federal Arbitration Act.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and will follow the terms of these Terms and Conditions as a court would.

If any provision herein is void or unenforceable in whole or in part, the remaining provisions of these Terms and Conditions shall not be affected thereby.

Any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, you agree to waive any right to a jury trial. Any party may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

Modification, and Severability

These Terms and Conditions are effective as of July 17, 2015 and will remain in effect except with respect to any changes made to these Terms and Conditions in the future, which will be in effect immediately after being posted on this page.
